Acceptable Usage Policy

* Introduction and Purpose *

This document sets forth the principles, guidelines and requirements of the Acceptable Use Policy of AxWeb Solutions governing the use by the Customer ( "Customer") of AxWeb Solutions's services and products ("Services and Products"). The Purpose of AxWeb Solutions's Acceptable Usage Policy, hereinafter referred to as the AUP, is to comply with all Federal, State, Provincial, and local laws coupled with protecting the server security, server availability, physical security, Customer privacy, and other factors affecting the services provided by AxWeb Solutions.

We accept your use of our service; therefore we do not actively monitor activity under normal conditions. Furthermore, we do not implement editorial control over the content of any Web site. This includes e-mail sending, newsgroup or other material created or available over or through the services, except for certain proprietary Web sites. However, in accordance with our Terms and Conditions, we hold full authority to remove any materials that, in our individual judgment, may be illegal, may subject us to liability or which may violate this Acceptable Use Policy. AxWeb Solutions reserves the right to oblige with legal establishment and/or third parties in the examination of any suspected or alleged crime or civil wrong doing. Violation of this AUP may result in the suspension or immediate termination of your AxWeb Solutions account and/or services. We do not routinely monitor the activity of accounts except for measurements of system exploitation, possible security or fraud risks and the preparation of billing records. However, in our efforts to promote good citizenship within the Internet society, we will respond appropriately if we become aware of improper use of our service.

You may not use your hosting account to circulate matters, which AxWeb Solutions determines, at its sole prudence, to be illegitimate, licentious or abhorrent. For purposes of this policy, "matters" refer to all forms of connections including narrative descriptions, graphics (including photographs, illustrations, images, drawings and logos), executable programs, video recordings and audio recordings.

* General Information *

AxWeb Solutions reserves the right to impose reasonable rules and regulations regarding the use of its services provided to all Customers and such rules and regulations are subject to change. The AUP is not an all inclusive exhaustive list and AxWeb Solutions reserves the right to modify the AUP at any time as needed. Acceptance and execution of the Services Agreement binds all parties to AxWeb Solutions's stated AUP at the time the contract is executed and as modified from time to time. Any violation of the AUP may result in the suspension or termination of Customer account(s) or such other action as AxWeb Solutions deems appropriate. No credits will be issued for any interruption in service resulting from policy violations. As a member of our hosting community, you must use your hosting account access responsibly.

VIOLATION OF ANY SECTION OF THE AUP IS STRICTLY PROHIBITED AND MAY RESULT IN THE IMMEDIATE TERMINATION OR SUSPENSION OF THE SERVICES CUSTOMER RECEIVES FROM AxWeb Solutions.

1. Shell accounts may not be used to do any type of compilation of any sort from C, C++ programs.

2. IRC are not permitted on any of the accounts given.

3. Hacking attempts, scanning will result a termination of your account.

4. High load average during your shell session, or at any other time, will not be permitted or tolerated.

5. Bouncers, BNC are not permitted on shell accounts given.

6. Snooping through system files or directories is consider a "hacking" attempt and will result in account termination.

7. Shell access is a privilege to use and should not be abused, suspension of shell will result if abused.

There are many choices for VPS hosting plans, created to host a game and a webhost

You AGREE not use the GSVPS to: (Windows/linux)

1. Host site nor Use as a webserver (contact us for more info).

2. Use for downloading huge files, which is not neccesary for Game Server or not related to Ragnarok.

3. Any illegal programs that can cause high CPU usage because every customers on the Node might suffer the lags due to high CPU usage for your VPS.

4. Any other game server depend on specs requirement.

Punishment: Suspension/termination!

Illegal Use: AxWeb Solutions's services may not be used for any purpose that violates any law, whether local, state, federal or international.

Fraudulent Activity: Use of AxWeb Solutions to violate any applicable federal, state, local or international laws is prohibited. You agree that you will not use AxWeb Solutions to commit a crime or fraud, or to plan, encourage or help others to commit a crime or fraud, including but not limited to engaging in a pyramid scheme, a ponzi scheme, or sending chain letters.

Forgery or Impersonation: Use of AxWeb Solutions to impersonate another user, falsify one's user name, age or identity in e-mail or in any post or transmission to any newsgroup or mailing list or other similar groups or lists is prohibited. You agree that you will not forge any message header of any electronic transmission, originating or passing through AxWeb Solutions.

Copyright or Trademark Infringement: Use of AxWeb Solutions to send or receive any information which infringes the patents, trademarks, copyrights, trade secrets or proprietary rights of any other person or entity is prohibited. This includes, but is not limited to digitization of music, movies, photographs or other copyrighted materials or software.

Adult Oriented / Objectionable Material: We expressly forbid anyone from using our servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, or pornographic material, or any other material which we deem to be objectionable, including, but not limited to, pornographic and swim suit material, racist material, satanic material, and any and all materials of an adult nature. The designation of any materials as such described above is left entirely to the discretion of our management.

Unsolicited Bulk E-mail (SPAM): Even though AxWeb Solutions cannot entirely control what e-mail our customers receive, we do take action against Subscribers that use our servers to send SPAM. If it is brought to our attention that one of our Subscribers is abusing their account regarding SPAM, then we will immediately suspend the offending Subscriber's account under the guidelines of our AUP and Terms and Conditions.

E-mail / News Bombing: Use of AxWeb Solutions to send a crippling number of files across a network is prohibited.

E-mail / Message Forging: Attempting to forged headers or other identifying information is prohibited. Using deliberately misleading e-mail addresses (user@domain.name.NOSPAM) in news postings in order to avoid SPAM e-mail address collectors is allowed.

Newsgroup SPAMing: Use of AxWeb Solutions to post a similar item to more than three newsgroups or mailing lists is prohibited. All post to any newsgroup must be in accordance with that newsgroup's policies.

Network Disruptions: Use of the AxWeb Solutions for any activity which affects the ability of other people to use AxWeb Solutions Services or the Internet is prohibited. This includes denial of service attacks.

Distribution of Viruses: Use of AxWeb Solutions to intentionally transmit computer "viruses", worms, "Trojan horses" or other harmful software programs is prohibited. User must make their best efforts to prevent the unintentional transmission of such viruses or other harmful software.

Misuse of System Resources: AxWeb Solutions hosting accounts operate on shared servers. What this means is there are many other domains hosted on one server. Excessive use of shared server resources by one Subscriber could have a negative impact for all Subscribers hosted on that server; therefore, we have certain restrictions regarding system resource usage. Our intent is to provide web hosting for web pages to our Subscribers for convenience of not having to worry about web space and data transfer usage. Subscribers are prohibited from excessive consumption of CPU and memory. Subscribers may not use resource-intensive programs which negatively impact other customers or the performance of the server. If the server performance is seriously deteriorated by Subscriber's use of account resources, AxWeb Solutions will suspend the account without any warning for 24 hours.

Excessive Resource Usage: Resources are defined as CPU usage, disk read/write usage, data transfer usage, and memory usage. This policy is only used in extreme cases to prevent misuse and is in effect to keep our servers fast and stable at all times. Subscriber's site shall not use more than 15 simultaneous processes. A single process from a Subscriber's site cannot use more than 10% of CPU or memory resources for longer than 60 seconds. The sum of all processes of a Subscriber's site cannot use more than 10% of CPU or memory resources at any time. Binary files such as images, video and sound (i.e. MP3, WAV, RA, GIF, JPG but not limited to those file extensions) may only account for a maximum of 50% of Subscriber's total bandwidth usage before Subscriber must upgrade to a higher performance solution.

Background Running Programs: We may allow programs to run continually in the background. These are considered on a one-to-one basis and an extra charge will be incurred based on system resources used and operational maintenance needed. Port forwarders are NOT allowed under any circumstances.  

Unauthorized Processes: Subscribers may not run unauthorized processes from their account due to adverse effects on server load, invitations to hackers/spammers/criminal activity, etc... This includes but is not limited to:
IRC bots, bouncers, clients

IP spoofers

Proxy servers

Screened processes

Server daemons

Port scanners

Mail bombers

Anonymous mailers

lstmrge.cgi

Greymatter

Movable Type

Shell, SSH, Telnet Scripts and Alternatives

ICQ clients or any form of instant messaging service

Any script that uses & processes a massive number of flatfiles or large flatfile databases

Multiple Accounts: Subscribers are not allowed to use multiple accounts to avoid overages. (Example: A download company orders two accounts. The company places some files on each account to avoid paying for additional disk space. This is not allowed.) This applies to our clients multiple accounts not allow!

Chat Rooms: We do not allow Subscribers to install chat rooms. Chat rooms tend to be large system hogs and we cannot allow it as an account option on our shared servers. The chat rooms that we provide are ok to use.

Forums: Subscribers are prohibited from installing forums without approval from AxWeb Solutions. There is generally no cost to run a forum. If the forum uses an excessive amount of system resources, an extra charge will be incurred based on system resources used by the forum. Forum software using flat-file databases (e.g. UltimateBB, YaBB, IkonBoard flat-file version) are strictly prohibited.

Comment Scripts: Scripts that allow visitors to post comments on your site are allowed only under the following conditions:

Subscribers must monitor all comments and take corrective actions within 24 hours for all comments that violate our Terms and Conditions and Acceptable use policies. Subscribers must delete all comment spam within 24 hours from the time the spam was posted. Subscribers that receive more than 10 instances of comment spam per day must implement a CAPTCHA or remove the comment script.

Disk Space: All (90%) of Subscribers web pages (html) must be 'linked' with files stored on the server. Web sites that are being used as storage for backups are prohibited. Sites found to contain no html documents, a large number of unlinked files, or sites being used as mirrors for archive files are subject to cancellation at the discretion of management. Sites with files running from their domain used on other domains is prohibited.

Unauthorized Access: We will strongly react to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include "internet scamming" (tricking other people into releasing their passwords), password robbery, security hole scanning etc. Any unauthorized use of accounts or computers by a user, whether or not the attacked account or computer belongs to us, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action.

Collection of Personal Data: Use of AxWeb Solutions to collect, or attempt to collect, personal information about third parties without their knowledge or consent is prohibited.

Harm to Minors: Use of AxWeb Solutions to harm or attempt to harm a minor, including but not limited to using AxWeb Solutions to send pornographic, obscene or profane materials is prohibited.

Threats And Harassment: Use of AxWeb Solutions to transmit any material that threatens or encourages bodily harm or destruction of property or which harasses, abuses, defames, or invades the privacy of any other person or entity is prohibited.

Unfriendly Activities: AxWeb Solutions users must be courteous and respectful at all times. Refrain from obscene, offensive, or rude language. Abusing or harassing other users or staff members by any method is prohibited and will result in service suspention or cancellation of Subscriber's account. Please respect the rules, others with whom you share the service, and the staff members who work hard to improve upon and provide you these services. Adherence to these guidelines will help to make use of the service a positive experience. If an issue arises that simply infuriates you, please consider canceling your account.

* Security *

You are responsible for any misuse of your account, even if the inappropriate activity was committed by a friend, family member, guest or employee. Therefore, you must take steps to ensure that others do not gain unauthorized access to your account. In addition, you may not use your account to breach security of another account or attempt to gain unauthorized access to another network or server.

1. Your password provides access to your account. It is your responsibility to keep your password secure.

2. Sharing your password and account access with unauthorized users is prohibited. You should take care to prevent others from using your account since you will be held responsible for such use.

3. Attempting to obtain another user's account password is strictly prohibited, and may result in termination of service.

4. You must adopt adequate security measures to prevent or minimize unauthorized use of your account.

5. You may not attempt to circumvent user authentication or security of any host, network or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, or probing the security of other networks. Use or distribution of tools designed for compromising security is prohibited. Examples of these tools include, but are not limited to, password guessing programs, cracking tools or network probing tools.

6. You may not attempt to interfere with service to any user, host or network ("denial of service attacks"). This includes, but is not limited to, "flooding" of networks, deliberate attempts to overload a service, and attempts to "crash" a host.

* Network Performance *

AxWeb Solutions hosting accounts operate on shared resources. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in suspend/termination of your account.

You are prohibited from excessive consumption of resources, including CPU time, memory, disk space and session time. You may not use resource-intensive programs which negatively impact other customers or the performances of AxWeb Solutions hosting or networks. AxWeb Solutions hosting services reserves the right to terminate or limit such activities.

* Revisions to this Acceptable Use Policy *

AxWeb Solutions hosting services reserves the right to revise, amend, or modify this AUP, our Terms and Conditions, and our other policies and agreements at any time and in any manner. Your continued use of AxWeb Solutions following the posting of changes to these policy will mean you accept those changes.
